About ZRC® and this Privacy Policy

ZRC® SA has its headquarters at 15 Rue du 31 Décembre, 1207 Geneva, Switzerland. In this Privacy Policy, we use the term ZRC® (as well as ‘we’, ‘us’, and ‘our’) to refer to ZRC® Genève SA, the company whose address is indicated hereinbelow, as well as its affiliates and its shops.

We ask that you please take a few moments to read the following policy, which explains how we collect, use, and may disclose and transfer the personal information that you provide to us on our websites, mobile applications, and other digital platforms (together, the ‘Platforms’), when you contact ZRC® Distributors and Ambassadors by telephone or when you interact with us via social media. It also explains how we collect information through the use of cookies and related technology when you use our Platforms.

When we offer our products for sale online or via telephone through the ZRC® Customer Relations Centre, you must take note of the applicable Terms and Conditions of Sale, which will determine the modalities and conditions of any and all purchases made through that channel.

Updates to this Privacy Policy

We may update this Privacy Policy at any time. In the event of an update, the changes will be posted on this Platform.

The information that you provide to us and how we use it

We may collect information about you as follows:

• In order to access certain areas of our Platform, you must register with our services. In the course of the registration process, you will be asked to provide personal information about yourself (including your name, address, date of birth, email address, and telephone number). By entering your information in the required fields, you authorise ZRC® to provide the services that you select;

• When you purchase products online, we collect information such as the details of your purchase and the relevant billing information. Moreover, we also collect personal information about you when you communicate with us (for example, if you contact us with a question about one of our products or services, when you provide your details whilst communicating with ZRC® ambassadors by telephone, or in person when you visit ZRC® distributors. Please note that telephone calls may be recorded for purposes of security, training, and service improvement;

• If you choose to interact with ZRC® via a social media platform or third-party service, we will collect the information that you have provided to us through the said platform;

• We will collect information about your location, insofar as we provide any location services, as described in the ‘Location Services’ section hereinbelow.

We may use the information that we collect from you to:

• Manage and respond to repair requests, and to provide after-sale services;

• Manage accounts and registers and activate warranties;

• Process your questions and requests;

• Send communications related to the service, including announcements and administrative messages, such as order confirmations;

• Identify the products and services that we believe may be of interest to you, based on information including your purchase history and your prior interactions with us;

• Send you marketing communications (including emails and social media messaging) about us and about third parties that we believe may be of interest to you, when we have a legitimate reason to do so (please see the ‘Your choices’ section below for further information about the way in which you can control these communications);

• Conduct market studies as part of the continuous improvement of the services that we provide to our clients;

• Perform credit checks, prevent fraud and other prohibited or illegal activity, and pursue our efforts to maintain the security of our Platform; and

• Understand the use of our Platform in order to make continuous improvements to the services on our Platform and to our other offerings.

When you have agreed to a specific use of your information, we process your information on the basis of your consent. You may retract that consent at any time (for example, in relation to the sending of marketing communications) by contacting us (see the ‘Contact us’ section below). We also process your information when it is necessary to do so in order to execute a contract with you or when it is necessary for our legitimate purposes for the pursuit, protection, and improvement of our business.

Cookies and other information that we collect automatically

Like most Platforms, ZRC® records AP addresses and uses cookies and other similar technologies that allow us to recognise you and to personalise your experience, as well as to provide us information about the way that visitors access our Platform. What is a Cookie?

Cookies are text files containing small amounts of information which are downloaded to your computer or mobile device when you visit a website or a mobile application. Internet Protocol (IP) Addresses

We collect information on your computer or mobile device including, when available, your IP address, your operating system, your login times, and browser type. We use this information in order to better understand how visitors use our Platform, as well as for internal reporting purposes. We will not share any of this information with advertisers, promoters, or other companies.

About advertising

Platforms rely on third parties, such as network advertisers and ad exchanges, to provide advertising on third-party platforms once you have left our Platforms. We use third-party analytic service providers and other service providers to evaluate and provide, either to us or to third parties, information about the use of the Platforms, as well as advertising and content views. We do not control the tracing technologies used by third parties, even if they are associated with our Platforms or our advertisements. You have options in regard to the advertisements shown to you. You may choose not to receive certain types of behaviourally targeted advertisements when visiting third-party websites, described in the section below, titled ‘How to control or delete cookies’. We are not responsible for the effectiveness or compliance of third parties’ opt-out mechanisms.

Sharing your information

We do not rent, sell, or share your personal information with other non-affiliated companies or individuals except under the following circumstances:

We will disclose your personal information to third-party suppliers for the purpose of provided online services and other payment, credit check, and fraud prevention services, as well as any other service necessary to allow us to use your information for the purposes specified in the section titled ‘The information that you provide to us and how we use it’;

We will disclose your personal information to any law-enforcement agency, court, regulatory authority, government authority, or other third party when we deem it necessary to do so in order to comply with a legal or regulatory obligation, or to protect our rights or the rights of a third party;

And

We will disclose your personal information to any third party that were to acquire or to which we were to transfer all or most of our assets and of our business activity. If such a sale or transfer were to take place, we will make every reasonable effort to ensure that the entity to which we transfer your personal information will use it in a manner compliant with this Privacy Policy.

International transfers

We have inserted standard contractual clauses in order to ensure that adequate guarantees are in place to protect your information when it is transferred to our affiliated distributors in territories located outside the European Economic Area and Switzerland. When we share your information with a third-party supplier located outside the European Economic Area and Switzerland (as detailed in the section titled ‘Sharing your information’), we contractually obligate the third-party service provider to establish adequate security measures to protect your information.

How we protect your information

We want you to use our Platform with confidence and we are committed to protecting the personal information that we collect. We limit access to your personal information to those employees having a reasonable need to have access to it in order to provide products or services to you or to fulfil their professional duties. We use appropriate physical, electronic, procedural, technical, and organisational measures to guard the personal information that you provide to us against any unauthorised or illegal use as well as against any loss, destruction, harm, or accidental destruction. Nonetheless, when we ask you to select a password to access certain parts of our Platform, it is your responsibility to select a secure password and to keep that password confidential. You must not select a password that you have already used for another site, and you must not share it with anyone.

Retention of your information

We retain your information only as long as is necessary for our purposes, in particular to protect ourselves in the event of a dispute (for example, information regarding a contract with you will be saved for the entire duration of that contract and for up to ten years after its termination). After that time, it will be deleted or, in certain cases, rendered anonymous. When we have requested your consent to process your personal information and we have no other legal reason to continue processing it, we will delete your personal information if you subsequently retract your consent.

If you ask us to stop sending you direct marketing communications, we will save a record of your request and your contact information in order to ensure compliance with your request.

Your choices

You have the right to request access to the personal information that we have about you in our files, to correct any errors, and to update any outdated information. Under certain circumstances, you have the right to request that your personal information be deleted or that its use be restricted.

You have the right to object to our processing of your personal information in certain cases. In particular, you may ask us at any time to stop sending you direct marketing communications (please note, however, that we may continue to send you communications related to the service [i.e., non-marketing communications], such as email updates regarding your order status). You may unsubscribe at any time from email marketing communications by sending us an email at the address listed below in the ‘Contact us’ section or by clicking on the ‘unsubscribe’ link in ZRC® marketing emails.

After reviewing your complaint, we will reply to you in writing within a reasonable timeframe, describing the corrective measures that we propose. If you believe that we have processed your information in a criminal manner or in a way that is contrary to your rights, you also have the right to file a claim with the Cantonal Office of Data Protection or a European Data Protection Authority in the jurisdiction where you reside or work or where the processing took place.
